Department of Fisheries sails towards sustainable success on addressing labour situation An exclusive interview with Dr. Adisorn Promthep, Director General of the Department of Fisheries, on the role and achievements of the Department in salvaging the labour situation in Thailand's fishery industry.Dr. Adisorn PromthepDirector General of the Department of FisheriesDr. Adisorn Promthep, Director General of the Department of Fisheries (DOF), Ministry of Agriculture and Cooperatives, revealed an overview of workforce solutions in Thailand's fishing industry."Several government agencies have been involved in various roles to solve labour problems in the fishery sector. Stopping human trafficking falls under the responsibility of the Ministry of Social Development and Human Security while the Ministry of Labour is in charge of the labour issues. As both affairs arise in the fishery sector, the DOF has to get involved. All agencies concerned jointly issued guidelines for Good Labour Practices, also known as GLP, to cover all activities in Thailand's fishing industry.Following issuance of the GLP guidelines, the DOF plays the lead role in provision of training courses for entrepreneurs and labour in the fishing industry. This year we have reached our target for GLP training workshops. Regarding labour on fishing vessels, the Department organised 11 GLP workshops for 858 commercial fishing vessel operators and shipmasters. Other GLP courses included five sessions for 250 employees from 120 seafood processing factories, 25 employers from 25 seafood primary processing sites, and ten sessions for 491 workers from shrimp farms.As the United States has still ranked Thailand as a Tier 2 country on its watch list, we will continue with our counter measures. Thailand needs to be more organised and put more measures in place. However, this is a problem all over the world. It isn't only in Thailand that there are labour and human trafficking problems. Hence implementing monitoring systems, surveillance and law enforcement are most important. We must do everything we can to sustain businesses and gain competitive advantage. If you ask if we will ease up on our measures, we will not. All concerned systems will continue to be regulated. Many laws and regulations have already been modified. Going forward, we also need to adjust rules governing our responses to situations that change all the time.The Department of Fisheries has achieved a certain level of success. Relevant legal matters have been clarified and new legal provisions laid out. The fishing sector uses a lot of migrant workers. Thailand's borders are fenceless. People from neighbouring countries can walk into our country to work illegally. Why do they come to work here? Because Thailand is prosperous. With high demand for migrant labour, you only have to come in and you will get a job for sure. Formerly, rules concerning migrants were unclear. Illegal workers risked being exploited. These things have existed for a long time even though the Thai government has put a lot of effort into regulating illegal migrants in the system. We have revised the rules to make them more flexible so that they can draw workers into conformity with the regulations. We have also provided an outline of the worker treatment scheme. Lawful migrant workers can make complaints and contact government offices and NGOs to seek help. They don't have to evade the law. It is much better for them to get into the system.These two-three million workers enjoy improved lives when they work in Thailand. They earn enough to send money to support their families in their native countries. This means Thailand is giving help to its neighbouring countries. In the future when they prosper more, labour mobility will change. With ASEAN merging, labour mobility is not a big deal anymore.Media gives more attention to workers on fishing vessels than those in other industrial fields. The farther fishing boats sail the less chance the workers have to contact other people. Working on a fishing boat is very tough. Inexperienced hands may get sea sick. Boat crew numbers are limited. If one or two fall ill, the rest must work twice as hard. Despite the hard work, the rewards are good enough. This sector has an attractive remuneration system.In terms of monitoring, we have numerous laws and regulations. We review all documents of the workforce on fishing vessels before a vessel departs. Formerly, employment was based on verbal agreements. Now it is made with a signed employment contract in a language that all parties comprehend. Workers know all the details and conditions of the agreement. Prior to departure, we inspect the number of workers, their names, their appearance, their IDs and employment contracts. On their return to port, we review them all again.Arrival monitoring gives the workers an opportunity to meet official staff. They can report mishaps during the work on the vessel, if any. Inspection staff includes representatives from the Royal Thai Navy, the Royal Thai Police, the Ministry of Labour, the Marine Department, the Customs Department, and fisheries agencies. Ships are kept under surveillance by the Royal Thai Navy, the Marine Department, the Customs Department and the Department of Fisheries patrols the sea on a regular basis.In terms of on-shore labour, the Department conducts regular reviews and inspections in many areas. Ministry of Labour and Ministry of Social Development and Human Security educate workers about their interests, regulations and labour laws that they should be aware of.There is a hotline using workers' native languages. I think every worker has a mobile phone, so they can make contact any time. All aspects of monitoring and protection of labourers is good enough. Employers who violate labour laws will be disciplined and receive severe punishment. Today, the operators wholeheartedly embrace the GLP guidelines. They see this as a benefit both to workers and their business. They understand that businesses that break the law exploit others and damage the overall business in the long run.As our system is well organised, the problem of illegal migrants is reduced and their wellbeing is improved. The Department of Fisheries aims to see that migrant fishery workers are able to develop their potential and that labour exploitation is ultimately wiped out completely."

A better standard and quality of life for workers in Thailands shrimp industry For over eight years, the Thai Frozen Food Association, membership of which includes enterprises involved in seafood processing for export, has played an important role in the implementation of Good Labour Practices (GLP) guidelines through its support and cooperation with the government sector in preparing regulations. The association created its own labour policy for enterprise members to properly implement and oversees the production chain to operate lawfully in line with other government regulations.Labour is an asset. Happy workers who have a good quality of life give a better performance.In the area of labour standards, enterprises involved in seafood processing for export operate in strict compliance with labour laws and Thailand’s Labour Standard, as well as other standards required by customers, such as SA 8000, ETI, and GLP. In addition, the plants focus on ethics and fairness in both Thai and migrant workers. They take care of all workers equally in all aspects, including living conditions, wages and welfare.Migrant workers in general seem satisfied with their quality of life. Whether Thai or migrant, all workers are treated equally. Most factories pay wages above the legal minimum, plus overtime and other fringe benefits such as working uniforms and boots. Transportation, accommodation, meals, and activities to celebrate festivals of Thai and other cultures attached to the migrants’ homelands are also provided for free or subsidised.Foreign workers are entitled to take home leave for extended periods of time. Some factories provide an interpreter so that workers can communicate easily while all essential documents are drawn up in a language that all parties comprehend. Another important element is the provision of welfare committees comprising both Thai and migrant workers. The committees represent all employees in discussions and negotiations with employers. Complaints boxes are also provided.The Thai Frozen Food Association, in collaboration between its members and various NGOs, organise activities to promote the quality of life for workers in many areas, including allocation of scholarships to children of Thai and migrant workers, religious and traditional activities, and social events such as to celebrate Mother’s Day, Children’s Day and Labour Day. To provide educational opportunities to children of Burmese migrants, the collaboration hires teachers who can communicate in Burmese to teach them.It is time for the seafood industry to recognise the importance of labour. Entrepreneurs throughout the chain must operate in compliance with labour laws, rules and ethical standards. This is an effort to enhance consumer confidence towards the quality of fishery products from Thailand and will sustain the Thai fishery industry in the long run. The industry now fully recognises that ethical treatment of workers leads to many benefits -- happy industry chain partners, happy life productive workers, high quality products, and successful and sustainable business.

Development of good labour practice In response to global market demand, companies have to incorporate social responsibility into their business and in line with the International Labour Organisation (ILO)'s Decent Work agenda involving responsibility for workers in the field of human rights, quality of life and workforce development.The Department of Fisheries (DOF), Ministry of Agriculture and Cooperatives, has partnered with several sectors to drive measures to protect workers in the fisheries industry based on all aspects of the Decent Work concept. In so-doing fisheries workers will have opportunities to improve their quality of life, employment and working conditions. The practice will give Thailand's fishery industry a good image and create sustainability and stability of Thai seafood products in international markets.With special care for workers in marine shrimp and related processing industries, the joint efforts between the Department of Fisheries, Department of Labour Protection and Welfare (DLPW), and other network partners developed the Good Labour Practices (GLP) Guidelines for Marine Shrimp Farms in Thailand. The essence of the guidelines is based on Thailand's labour laws and international labour standards, as well as good practice principles that operators should adhere to.Checklists were created for operators/employers of shrimp farms in Thailand to achieve a certain scope for good labour practices:1. Employer checklist to prevent forced labour: Employers must understand what constitutes forced labour. In case of employing migrant workers, make sure they are not subject to illegal labour conditions, and treat them as equal to Thai workers and in line with international labour standards.2. Employer checklist to prevent child labour: Youths younger than 18 years of age cannot be hired. The age of potential employees is verified using both written document(s) and interviews with workers about their age.3. Employer checklist concerning freedom of association, collective bargaining and workplace cooperation: Workers must be free to associate, organise and represent their interest vis-à-vis the employers and to freely discuss matters concerning their working conditions, entitlements and rights.4. Employer checklist for discrimination: Employers must apply the principle of Equal Working Conditions for All. Workers must not be treated differently based on their race, nationality, religion, political opinion or sex. Instead, decisions regarding workers are based on their qualifications and experience.5. Employer checklist for wages, compensation and working time: Workers need to be paid according to minimum wage, with a premium for overtime hours worked. Wages need to be paid regularly and directly to the workers. Regular and overtime hours must be within legal limits.6. Employer checklist for occupational safety, health and welfare (OSH): While ensuring compliance with OSH requirements is mainly the responsibility of the employer, workers also have a key role in keeping the workplace safe and ensuring that appropriate safety and health measures are taken.The aforementioned checklist set is a tool to help employers verify that their workers are treated legitimately. The GLP Guidelines for Marine Shrimp Farms in Thailand also helps entrepreneurs to improve the working environment, to enhance safety, health and wellbeing of labour. All this is designed to create a good image of made-in-Thailand products and strengthen the country's trade competitiveness in general.In fiscal year 2016, the DOF and DLPW have jointly conducted ten (10) batches of seminar entitled; 'GLP Guidelines to Strengthen Entrepreneurs in Shrimp Farms'. The seminars were participated in by 387 entrepreneurs and 104 DOF officials from 16 provinces -- Songkhla, Nakhon Si Thammarat, Surat Thani, Rayong, Chon Buri, Chanthaburi, Trat, Chachoengsao, Trang, Satun, Krabi, Phuket, Phangnga, Prachuap Khiri Khan, Chumphon, and Ranong.The seminar achieved its objectives to enhance knowledge and create understanding on the GLP Guidelines for Marine Shrimp Farms. It is also being platforms for shrimp farmers and stakeholders in the shrimp industry to exchange view and make their preparedness to apply the GLP guidelines in shrimp farms throughout Thailand from now on.

GLP training programmes for the better of fishery industries in Thailand The Department of Fisheries, Ministry of Agriculture and Cooperatives, has taken measures to prevent and eliminate child labour, forced labour, slave labour and illegal migrant workers in shrimp and seafood industry of Thailand. The fishery industries have played a vital role to Thailands economy, with the annual export value at 270,000 million baht and over one million workers throughout the industrys production chain. Responding to the concept of decent work, Good Labour Practices (GLP) guidelines for seafood processing factories and primary processing workplaces were developed. The guidelines encompass Core Labour Standards; Forced Labour, Child Labour, Freedom of Association, Collective Bargaining and Workplace Cooperation and Discrimination (Equal Employment Opportunities and Treatment). Whilst working conditions herein covers Work Contracts, Wages, Compensation and Work Time, Occupational Safety and Health, and Work Environment and Worker Welfare. Following the guidelines, the department has created the campaigns to raise awareness and to adjust attitude among operators/entrepreneurs towards treatment of employees which will benefit to both Thai and migrant workers. Should operators/entrepreneurs follow the guidelines properly; the industries will be free from labour issues and unsafe working environments and human trafficking will also be completely eliminated. In terms of raising GLP awareness, the department has organised a training workshops for operators/entrepreneurs on Good Labour Practices for Seafood Processing Factories and Primary Processing Workplaces. The training course comprised lectures and team learning activities. In fiscal year 2015, the department trained 56 participants from 52 primary seafood primary processing workplaces and 97 participants from 59 seafood processing factories, located in Samut Sakhon, Samut Songkhram, Nakhon Pathom, Samut Prakan, Ratchaburi, Ranong, Surat Thani, Nakhon Si Thammarat, Chumphon, and Phuket provinces. In fiscal year 2016, during November-December 2015, four GLP workshops were conducted, with 23 participants from 15 primary seafood primary processing workplaces and 135 participants from 75 seafood processing factories, located in Samut Sakhon, Samut Songkhram, Nakhon Pathom, Samut Prakan, Ratchaburi, Chachoengsao, Chon Buri, and Rayong, joined in these 4 workshops. Besides knowledge, the training programme raises awareness and enables effective implementation of the GLP guidelines in the industries. The campaign aims to have operators willingly embrace the GLP guidelines in order to prevent malpractices and to sustainably promote decent working conditions in the industries. This will lead to a positive impact on the quality of fishery products from Thailand and reassure consumers that they are ethically produced in compliance with the proper labour standards.

Progress in Resolutions for Labour Problems in Thai Fishery Industries The Thai Government has been making steady progress in solving labour problems in Thai fishery industries. Following the master plan formulated in 2014, the Department of Fisheries has been implementing the resolutions as follows:Promotion of Good Labour Practices (GLP)In order to eliminate the worst forms of child labour, mostly found in shrimp and seafood processing factories, and to promote the workers in Thai fishery industries to have good working conditions, safety, quality of life and welfare in line with international standards, the Department of Fisheries in collaboration with the Department of Labour Protection and Welfare, Department of Employment, Ministry of Labour, International Labour Organisation (ILO), Thai Fishery Producers Coalition (TFPC) and NGOs, including Labour Rights Promotion Network (LPN), has formulated 4 GLP guidelines; 1) GLP guideline for primary processing workplaces, 2) GLP guideline for shrimp and seafood processing factories, 3) GLP guideline for marine shrimp farms, and 4) GLP guideline for fishing vessels. From October 2015 - March 2016, the Thai Government promoted GLP to 543 Marine shrimp farms. Conducting Fishing Vessel legalisation to prevent IUU fishing and human traffickingThe Department of Fisheries and the Marine Department has been conducting fishing vessel legalisation by revising 2 regulatory systems: 1) the Thai fishing vessel registration system and 2) the fishing license issue system. Doing this helps the Thai Government know the actual number of fishing vessels operating in Thai waters. This also makes the prevention of IUU fishing under the Royal Ordinance on Fisheries B.E.2558 more effective. Moreover, the Department of Fisheries has developed a database for fishing vessels, and made linkages to other databases, such as for fishing gear and fishing labour, that belong to other government agencies comprising the Marine Department, Department of Provincial Administration, Ministry of Labour, Royal Thai Navy and Marine Police Division. As a result, monitoring, control and surveillance activities against IUU fishing in Thailand has become much more effective. Accelerating registration for migrant workersThe Thai cabinet resolved to expand the registration period of migrant workers in marine fishing. The expiration date has been extended from January 30, 2016 to July 31, 2016. Registered migrant labour is, therefore, legally permitted to work until 31 January 2017. The Department of Fisheries has urged fishery industries owners to get their migrant labour registered at One Stop Service registration points nationwide. The record shows that as of May 3, 2016, Thailand has 12,504 migrant workers registered as labour on fishing vessels. Joint Inspection of fishing vessels and labour on board The Department of Fisheries, in collaboration with the Marine Department, Department of Employment, Department of Labour Protection and Welfare, and Thai Marine Police Division, have formed a multidisciplinary team to monitor fishing vessels and fishing labour on board in Thai waters along 22 coastal provinces. The Department of Fisheries provides nineteen (19) of the sixty (60) feet in length and over fisheries patrol vessels for this activity. There are fifteen (15) patrol vessels operating joint inspections in the Gulf of Thailand and another four (4) in the Andaman Sea. From October 2015 - September 2016, it is expected to perform 60 joint inspection operations. So far twenty-eight (28) operations have been conducted, 238 fishing vessels have been inspected and five cases have been found in violation of law and sent for prosecution.Enhancing confidence in Thai fishery products in international marketsThe Thai missions have participated in international events and trade shows. The aims are to provide public understanding about the quality of Thai fishery products and to reiterate that the whole production chain has not engaged in illegal labour. The Department of Fisheries in cooperation with relevant government agencies and private sectors, sometimes including the International Labour Organisation, has jointly hosted various events such as exhibitions, seminars, and international meetings in cities; Boston, USA and Brussels, Belgium. Discussions with international customers at the events opened opportunities for the Department of Fisheries to explain and present the solid progress that is being made in preventing labour problem and combating IUU Fishing in Thailand.

Masterplan of the resolutions for labour problems in Thai fishery industries: Ensuring legal labour practices in Thai fisheries The Department of Fisheries, Ministry of Agriculture and Cooperatives, as a core agency overseeing for Thai fishery; aquaculture; and fish processing products, is committed to tackle labour problems in the seafood industries. Recently, the Department has put in motion a plan to protect labour rights and resolve human trafficking in the fisheries industry, from upstream to downstream along the entire supply chain, in line with the national agenda addressing the human trafficking problems.This effort has led to the advent of the Masterplan for Labour Problem Resolutions in the Fishery Industries following the consensus of the Coordinating Subcommittee on Migrant Workers in the fisheries sector dated June 22, 2014, where some practical guidelines were determined to solve human trafficking in fishery industries. The Department of Fisheries, associated with the Marine Department, was commissioned to implement the fishing vessels legalization as well as to develop fishing vessel port in – port out control system. The Department of Fisheries was also assigned to formulate a Masterplan to solve labour problems in the fishery industries and to set up public hearing.The Masterplan received positive comments and gained agreement for comprehensive and proactive planes that will effectively integrate all parties concerned.The Masterplan has been approved by the National Council for Peace and Order (NCPO) and Chairman of the National Policy Commission on Labour Migration. The Masterplan will help resolve problems relating to labour migration and human trafficking in the fishery industries more effectively.The Masterplan of the Labour Problem Resolutions in the Fishery Industries comprises 10 key plans, as follows: Plan to promote the Good Labour Practice (GLP) guidelines for primary processing workplaces and the GLP guidelines for shrimp and seafood processing factories.Plan to develop GLP Platform or monitoring system for Thai fishery industries.Plan to conduct fishing vessel legalization to prevent IUU fishing and human trafficking.Plan to accelerate the migrant workers in fishing vessels for legal registration.Plan for joint inspection of fishing vessels and labour on board to prevent and combat IUU Fishing.Plan for joint inspection Thai fishing vessels in Thai waters.Plan for joint patrol Thai oversea fishing vessels.Plan to provide training programs on preventing and combating human trafficking to government officials and relevant private sectors.Plan to enhance confidence in Thai fishery products for international markets.Plan for an establishment of the Fishery Labour Screening Center in the origin countries of migrant workersThe Masterplan of the Labour Problem Resolutions in the Fishery Industries will considerably improve working conditions of fisheries labour, whether Thais or migrants. New Royal Ordinance on Fisheries for betterment of Thailands fishery management The world, now, takes the view that IUU fishing is a problem tied in with labor/human trafficking. With the purpose of eliminating IUU fishing and other illegal fishing activities, the new law imposes severe punishment. As a result, those people concerned with fishing operation and downstream industry should pay attention to and study the law deliberately. The Royal Ordinance on Fisheries B.E. 2558 (2015) has been enacted and has entered into force since November 14, 2015. The law aims to reorganize fisheries in Thailand in compliance with international measures and regulations on combating Illegal, Unreported and Unregulated (IUU) Fishing. Upon the capacity of the new law, apart from controlling fishing vessels, it encompasses the downstream industry. This is in accordance with the Government policy against IUU Fishing and labor/human trafficking in fishery sector. Details of this new law are as follows: Section 11. A factory operator under the law on factories who engages in a business relating to aquatic animals is prohibited from employing a person in violation of the law on labour protection or an alien who does not hold a licence under the law on working of aliens. In the case where a competent official finds a violation under paragraph one, if the number of persons employed unlawfully found at the factory is not more than five, the competent official shall forthwith report to the Director - General, and the Director - General shall order the suspension of the factory operations for a period of ten to thirty days. In the case where a competent official finds a violation under paragraph one, if the number of persons employed unlawfully found at the factory is more than five, the competent official shall forthwith report to the Director - General, and the Director - General shall notify the Permanent Secretary of the Ministry of Industry to order the closure of the factory pursuant to the law on factories. In the case where the competent official finds that a factory operator whose license has been suspended under paragraph two has committed another violation under paragraph one within a period of three years as from the order of suspension, the competent official shall forthwith report to the Director - General, and the Director - General shall notify the Permanent Secretary of the Ministry of Industry who shall order the closure of the factory pursuant to the law on factories. A factory operator who has received a factory closure order under paragraph three or paragraph four shall be prohibited from operating a factory to engage in a business relating to aquatic animals and the licensor under the law on factories shall not issue a license for the operation of a business relating to aquatic animals to such person. An order of factory closure under this section shall have the effect of license revocation for Category 3 factories under the law on factories. Section 82. Prior to proceeding with the port-out procedure pursuant to section 81, the owner or the master of a fishing vessel shall submit documents related to vessel registration, the vessel use permit, the fishing licence, details of the number and a list of outgoing seamen on board, evidence of authorisation, license and permit under section 83, as well as evidence related to the provision of appropriate systems for ensuring occupational safety, hygiene and wellbeing of seamen as prescribed in the Ministerial Regulation to the competent official at the Port In ?Port Out Controlling Centre in accordance with the rules and procedures prescribed by the Director - General. In the case where the owner or the master of a fishing vessel fails to submit the documents and evidence pursuant to paragraph one, or the provision of a system for ensuring occupational safety, hygiene and wellbeing of seamen does not comply with the requirements stated in the Ministerial Regulation, the competent official shall order the detention of the fishing vessel at the fishing port or order the return of the fishing vessel to the fishing port. Section 83. A seaman must hold a seaman document issued under the law on navigation in Thai waters. In the case of a seaman who is not a Thai national, a permit to remain in the Kingdom under the law on immigration and a work license under the law on working of aliens must also be obtained. For the purposes of administrative facilitation, the Director - General shall have the same powers as the Harbour Master under the law on navigation in Thai waters, with respect to the issuance of seaman documents, the Commissioner General of the Royal Thai Police under the law on immigration, with respect to the issuance of a permit for temporary stay in the kingdom for aliens working on fishing vessels, and the Registrar under the law on working of aliens, with respect to the licensing of aliens working on fishing vessels which engage in fishing operations at sea. When granting a permit or license under paragraph three, the Director - General must comply with rules, procedures and conditions prescribed by the Council of Ministers. Upon issuance of a permit or license, the Marine Department, Royal Thai Police and Department of Employment must be notified accordingly. The foregoing provisions, however, do not prejudice the rights of a seaman to apply for a seaman document under the law on navigation in Thai waters or to apply for a permit or license under the law on immigration and law on working of aliens. The Director - General shall have the power to issue a seaman document and evidence of licensing or permission to a seaman in accordance with the form prescribed by Notification of the Director - General. The seaman shall keep such evidence with himself/herself or at a safe place in the fishing vessel in which he/she is stationed. The seaman document, permit or license issued under paragraph two shall only be valid for working on board the fishing vessel specified in the evidence document, in the vicinity of the fishing port, and only during the period specified therein. Pursuant to Section 124, any person who violates Section 11 paragraph one shall be subject to a fine of 400,000 baht to 800,000 baht per each unlawfully employed person. Any person who operates a factory in violation of section 11 paragraph two, paragraph three or paragraph four shall be liable to a term of imprisonment not exceeding two years or to a fine of 200,000 baht or 2,000,000 baht, or both, and a daily fine of 100,000 - 500,000 baht per day for the entire duration of the violation. Under Section 153, the owner of any fishing vessel making use of a seaman without a license or permit pursuant to Section 83 shall be subject to a fine of between 400,000 baht per seaman, and the Director - General shall order the revocation of the owners fishing license. The Director - General of the Marine Department shall also revoke the seaman document of the master of the vessel pursuant to the law on navigation in Thai waters. Upon severe punishment and higher fine imposed by the new law, it will bring about deterrence and elimination of labor/human trafficking in fishery sector.
